Açık Radyo’nun karasal yayın lisansı RTÜK tarafından resmi olarak iptal edildi.
Türkiye’de ve belki de dünyada en geniş çapta ses ve ifade biçimlerine muazzam bir alan açmış radyomuz tamamiyle bürokratik ve teknik bir gerekçeyle ifade özgürlüğünden mahrum bırakılıyor.
Oysa milyonlarca dinleyicisinin kolaylıkla şahitlik edebileceği gibi Açık Radyo bunca yıldır yaratmış olduğu toplumsal etki sayesinde susturulamaz.

En son Kamuoyu’na yapmış olduğumuz 10 Temmuz 2024 tarihli açıklamada, Ankara 21.ci İdare Mahkemesi’nin vermiş olduğu “yürütmenin durdurulması” kararına karşı RTÜK tarafından yapılan itirazın reddolduğunu ve bu doğrultuda yayına devam edildiğini paylaşmıştık.
Ancak, Ankara 21’inci İdare Mahkemesi tarafından alınan 27.09.2024 tarihli yeni karar ile bu kez “yürütmenin durdurulması isteminin reddine” karar verildiği tarafımıza bildirilmiştir. Bu karara karşı yasal çerçevede itiraz edilmektedir.
Yürütmenin durdurulması isteminin reddine karşı yasal itiraz süreç devam ederken, maalesef, Radyo ve Televizyon Üst Kurulu’nun 03.07.2024 tarih ve 2024/25 nolu toplantısında 16 nolu karar ile alınan; fakat daha evvel verilmiş olan yürütmenin durdurulması kararı sebebiyle tarafımıza tebliğ edilmemiş bulunan “YAYIN LİSANSININ İPTALİ” kararı 11.10.2024 tarihinde yani bugün tebliğ edilmiştir
Dolayısıyla, 30 yıldır devam eden, 95.0 frekansından yaptığımız karasal yayınımız, tebliğ edilen karar doğrultusunda RTÜK tarafından kapatılacaktır.
Elbette, gerek yürütmenin durdurulması talebinin reddine dair karara ve gerekse yayın lisansının iptali kararına karşı yasal yollara müracaat edilecek ve hukuki mücadelemiz sürecektir. Açık Radyo olarak, yukarıda belirttiğimiz yasal yollar çerçevesinde, karasal yayın hayatımıza ilişkin bu ayrılığın, geçici olacağını ve bir an önce sona ereceğini umuyoruz.

Bundan tam bir ay sonra 30. yayın yılına girecek olan Açık Radyo, bugüne dek layık görüldüğü sayısız ödülün de gösterdiği gibi çevre ve iklim mücadelesinden halk sağlığına, toplumsal cinsiyet eşitliğinden çok-kültürlülüğe pek çok alanda sivil sesler için megafon işlevi görmüş; sadece radyo frekanslarıyla da sınırlı kalmayıp tasarımdan edebiyat ve sosyal bilimlere, sahne sanatlarından plastik sanatlara uzanmış bağımsız bir mecra olarak bundan sonra da görevini sürdürecektir.
Tüm dinleyicilerimizi, meslek örgütlerini ve uluslararası kamuoyunu, Türkiye'de basın ve yayın özgürlüğü adına telafisi mümkün olmayan bir kayba yol açan bu RTÜK kararına karşı, “kâinatın tüm seslerine, renklerine ve titreşimlerine Açık Radyo” adına bu sefer çok daha net ve gür bir biçimde ses çıkarmaya davet ediyoruz.

Public Announcement: Açık Radyo’s Terrestrial Broadcast to Be Shut Down by RTÜK
Açık Radyo’s terrestrial broadcast license has been officially cancelled by RTÜK, the Radio and Television Supreme Council.
Our radio has offered an immense platform to the broadest forms of sound and expression in Turkey and also across the world - yet now, we are being deprived of our freedom of expression on entirely technical and bureaucratic grounds.
As its millions of listeners will confidently testify, it is thanks to the social impact Açık Radyo has created over so many years that our radio cannot and will not be silenced.

In our most recent statement to the public dated 10 July 2024, we shared with you that the objection filed by RTÜK against the stay of execution ruling given by the Ankara 21. Administrative Court had been rejected, and that, in line with this ruling, we would continue our broadcast.
However, on 27 September 2024, the Ankara 21. Administrative Court issued a new ruling, and has notified us that “the request for stay of execution has been rejected”. We are filing an objection to this ruling within the necessary legal framework.
Unfortunately, as the legal process against the rejection of the request for stay of execution continued, decision no 16 for the “CANCELLATION OF BROADCAST LICENSE”, taken at RTÜK’s meeting no 2024/25 dated 3 July 2024, which we were not notified of at the time due to the ruling for stay of execution, was formally served to us today, on 11 October 2024.
Thus, our terrestrial broadcast which has continued from the frequency 95.0 for 30 years will be shut down by RTÜK in line with the served decision.
We will naturally apply through legal means against both the ruling to reject the request for stay of execution and the decision for the cancellation of our broadcast license, and our legal struggle will continue. As Açık Radyo, within the framework of the legal means stated above, we believe that this forced parting regarding our terrestrial broadcast shall prove temporary, and that it will come to an end as soon as possible.

Açık Radyo’s 30th anniversary is exactly a month away, and as the numerous awards it has received show, our radio has become an amplifier for civilian voices in many fields from the struggle for climate and the environment to public health, and from gender equality to multiculturalism. Açık Radyo has not restricted itself to radio frequencies, and there can be no doubt that it will continue its duty as an independent medium that has embraced a wide of range of fields from design to literature, and to the social sciences, the performing arts and visual arts.
We invite all our listeners, professional organizations and the international public to raise an even clearer and louder voice for Açık Radyo, a radio “open to all the sounds, colours and vibrations of the universe” and against this RTÜK decision that will result in irreparable loss for press freedom in Turkey.
