Daha evvel kamuoyuna duyurduğumuz üzere, RTÜK tarafından Açık Radyo-Açık Gazete programına 24 Nisan 2024 tarihli yayında yer alan ve ifade özgürlüğü kapsamında olduğuna şüphe bulunmayan ifadeler sebebiyle beş gün program durdurma kararı verildiği tebliğ edilmişti. Yine aynı tebligatta yer alan Üst Kurul kararında, durdurmanın hangi tarihler arasında uygulanacağının tebliğ edileceği de kaydedilmişti. Bu doğrultuda, durdurma için gün bildirimini beklerken RTÜK’ün 3 Temmuz 2024 tarihli toplantısında, Açık Radyo’nun yayın lisansının iptal edildiğini öğrendik. Bu son gelişmeye dair henüz tarafımıza ulaşan resmi bir tebligat bulunmamakla beraber, sosyal medyadan öğrenildiği kadarıyla kararın gerekçesi, tebligata rağmen RTÜK’ün program durdurma kararına uyulmaması.
RTÜK’ün web sitesinde dün (4 Temmuz 2024) yayınlanan kamuya açık duyuruda konuya ilişkin izahat paylaşıldı: “tebligatın 31.05.2024 tarihinde okunduğu dikkate alındığında bahse konu kuruluş hakkında (…) “yayın lisansının iptaline” karar verilmesi yönünde işlem tesis edilmesi mevzuat gereğidir”.
Biz şimdi tebligat sürecinin bizim tarafımızda nasıl geliştiğini ifade etmeye çalışalım.
Duyuruda belirtildiği gibi Üst Kurul, Ulusal Elektronik Tebligat Sistemi (UETS) aracılığıyla 31 Mayıs 2024 tarihinde radyoya bir tebligat iletmişti. Burada Üst Kurul’un 21 nolu kararının da bulunduğu iki dosyaya ulaşılmış ancak bir üçüncü dosyaya UETS sisteminden kaynaklanan teknik-elektronik bir nedenden dolayı erişim söz konusu olmamıştır. Dolayısıyla söz konusu dosya yasa gereği iletilmesinden beş gün sonra tebellüğ edilmiş sayılsa da içeriğinden teknik koşullardan ötürü haberdar olmamız mümkün olmamıştır. RTÜK’ün açıklamasında da yer aldığı üzere söz konusu dosya, elimize posta yoluyla ulaşan ilk tebligatta bulunmayan yayın durdurma tarih ve saatlerinin detaylarını ihtiva etmektedir.
Anılan dosyadaki ifadeye göre; Açık Radyo hakkında 6112 sayılı (…) Kanun’un 32’nci maddesinin birinci fıkrasına göre idari tedbir olarak, ihlale konu program yayınının 10, 11, 12, 13, 14 Haziran 2024 tarihlerinde Saat 08:00'de olmak üzere takdiren “5 (beş) kez durdurulmasına” karar verilmiştir.
Bu detaylara daha önce de belirttiğimiz gibi UETS sisteminden kaynaklanan teknik bir nedenden dolayı ulaşılamamış olduğu için Açık Radyo yayın durdurma gününün tebliğini beklemiş ve yayınına devam etmiştir.
Öte yandan radyomuz, kararda ve bize posta yoluyla ulaşan ilk tebligatta belirtilen para cezasının ödenmesi için 14 Haziran tarihinde RTÜK’e yazılı müracaatta bulunmuş ve RTÜK’ün 26 Haziran tarihli geribildirimi doğrultusunda taksitlendirilen ödemenin ilk taksidinin ödemesini gerçekleştirmiştir. Erişilemeyen dosyayı bilmediğimiz ayın 14’ünde yaptığımız başvurudan anlaşıldığı gibi, taksitlendirme talebimizi kabul ile 26 Haziran tarihinde bize cevap veren ve taksitlendirme önerilerini gösteren cevabında RTÜK’ün bize bir ikazda bulunmadığı da anlaşılmaktadır. Ayrıca RTÜK’ün son duyurusunda uyduğumuz para cezası ödeme sürecinden hiç bahis açılmadığına da özellikle işaret etmek isteriz.
Tekrar söylemek gerekirse: Radyomuzun, RTÜK kararını yerine getirmeme yönünde bir iradesi bulunmamakta olup; kararın yerine getirilmesine yönelik olarak, idari para cezasının ödenmesi için gerekli müracaat sonrası ilk taksit ödemesi de yapılmıştır. Yayın durdurma kararının yerine getirilememiş olmasının bu nedenle UETS’den kaynaklanan teknik aksaklığın bir sonucu olduğu kesindir.
RTÜK’ün, lisans iptaline hüküm veren kararıyla ilgili yasal müracaatlar elbette yapılacaktır. Bununla beraber, 30 yıldan beri yayın hayatına devam eden Açık Radyo’nun “geri dönüşü olmayan bir zararla” karşı karşıya kaldığı açık olduğu gibi Anayasa tarafından güvence altına alınan ifade ve haber alma özgürlüğünün ihlaline tekabül eden son durum, son derece vahimdir.
İlk günden bu yana evrensel gazetecilik ilkeleri doğrultusunda yayın hayatına devam eden Açık Radyo’nun, bundan sonra da aynı yasal statü doğrultusunda yayın hayatına devam etmesi en temel demokrasi ilkelerinin de gereğidir.

Public Release III – About the Notification Process
As we previously announced to the public, we were notified by RTÜK (Turkey's media regulator, Radio and Television Supreme Council) that a five – day broadcast suspension was imposed on Açık Radyo for the statements - which should by all means be considered within the scope of freedom of expression - made during the broadcast of Açık Radyo – Açık Gazete on April 24, 2024. In the same notification it was noted that the dates of broadcast suspension will be communicated later. In this regard, while waiting for the notification of the dates of broadcast suspension, we learned that Açık Radyo's broadcasting license was revoked at RTÜK’s meeting on July 3, 2024. Although we have not yet received an official notification regarding this latest development, we learned from social media that the reason for the decision was Açık Radyo’s failure to comply with RTÜK's suspension decision despite the notification.
In a public announcement posted on RTÜK's website yesterday (July 4, 2024), an explanation regarding the issue was shared: "Considering that the notification was read on 31.05.2024, it is necessary by law to take action to "cancel the broadcasting license" of the mentioned organization."
Now, let us try to explain how the notification process took place on our side.
As stated in the announcement, the Higher Council had sent a notification to our radio station on May 31, 2024 via the National Electronic Notification System (UETS). Two files, including decision number 21 of the Higher Council, were accessed, but a third file could not be accessed due to a technical-electronic reason related to the UETS system itself. Therefore, although the mentioned file is considered to have been notified five days after the legal notification, we were unable to access it and thus see its content due to technical reasons. As also stated in RTÜK's statement, in the mentioned file the details of the dates and times of the broadcasting suspension were communicated but no such information was included in the first notification we received by mail.
According to the information in the mentioned file; due to a violation an administrative measure was taken regarding Açık Radyo in accordance with the first paragraph of Article 32 of Law No. 6112 (...) and it was decided to suspend the broadcast of the program in question on June 10, 11, 12, 13, 14, 2024, at 08:00 for "5 (five) times."
As we mentioned earlier since we were unable to access the details of the broadcast suspension date and time due to a technical reason arising from the UETS system, we waited for the notification and continued our broadcast.
Furthermore, our radio station applied in writing to RTÜK on June 14 to pay the fine stated in the decision and made the first installment of the payment according to the feedback RTÜK gave on June 26. The fact that we had not been able to access the mentioned file and thus did not know about the exact broadcast suspension dates can be easliy deduced from the request we made to pay the imposed fine on June 14. RTÜK accepted our request and did not warn us about the broadcast suspension dates in its response. In the response we were only informed about our application’s result and installment plan proposals. We also want to emphasize that there was no mention of the payment process of the fine we complied with in the latest announcement of RTÜK either.
Once again we would like to reiterate: Our radio station does not have any intention of not complying with RTÜK’s decision and the first installment payment for the administrative fine has already been made. It is clear that the failure to implement the broadcast suspension decision is a result of the technical inconvenience arising from the UETS.
Legal appeals regarding RTÜK's decision to cancel the license will certainly be made. However, it is clear that Açık Radyo, which has been continuing its broadcast for 30 years in line with universal journalistic principles, is faced with an "irreversible damage" and this decision which is clearly a violation of freedom of expression and the right to be informed guaranteed by the Constituiton has grave consequences.
It is the most basic requirement of democracy that Açık Radyo, which has been continuing its broadcast from the very first day in accordance with universal journalistic principles should continue its broadcast in the same direction with the same legal status in the future.
